1. About us
These terms (the "Terms") apply to your use of www.yanniscompetitions.co.uk (the "Site") and your entry into any prize competition operated by IDVS LTD, a company registered in England & Wales, trading as Yannis Competitions ("we", "us", "our", the "Promoter"). Registered office: 87 Peartree Road, Derby, DE23 6QB. Contact: admin@yanniscompetitions.co.uk.
All competitions on the Site are free-to-enter skill-based prize competitions run under the lawful exemption in section 339 of the Gambling Act 2005 and are not a lottery or a licensable gambling product.
2. Acceptance of these Terms
By ticking the "I agree to the Terms & Conditions and Privacy Policy" box at sign-up, and/or by entering any competition, you confirm that you have read, understood and agree to be legally bound by these Terms, our Privacy Policy, our Cookie Policy, our Responsible Play Policy, and the specific rules of any competition you enter. If you do not agree, you must not use the Site or enter any competition.
By entering any competition you expressly agree that, if you win, you will participate in filmed publicity (including live-streams and social-media footage) and will travel to Yannis Desserts, 87 Peartree Road, Derby, DE23 6QB on the day of the draw to collect your prize in person. These requirements are a condition of entry and are necessary for us to demonstrate the legitimacy of our competitions to viewers.
3. Eligibility
- You must be aged 18 or over at the time of entry.
- You must be a resident of the United Kingdom (England, Scotland, Wales, Northern Ireland), the Channel Islands, the Isle of Man or the Republic of Ireland, unless otherwise stated for a specific competition.
- Employees, contractors, directors and immediate family members of Yannis Competitions, and anyone professionally connected with the administration of a competition, are not eligible to enter.
- You may only register and hold one account. Duplicate, multiple or fraudulent accounts will be closed and entries forfeited without refund.
- By entering you confirm all information you provide is true, current and complete. We may refuse, void or disqualify entries where details are false, unverifiable or incomplete.
4. How to enter
There are two ways to enter every competition:
- Paid entry โ purchase one or more tickets on the Site, correctly answer the skill-based question shown on the competition page, and complete payment.
- Free postal entry โ send a postcard following the procedure on our Postal Entry page. Free entries have exactly the same chance of winning as paid entries.
Entries are only valid once a correct answer to the skill question has been submitted and (for paid entries) payment has cleared. We are not responsible for entries that are delayed, lost, corrupted, mis-addressed or that fail to reach us due to network, postal or technical issues outside our reasonable control.
5. Skill-based question
Every competition includes a question that requires a genuine exercise of skill, judgement or knowledge. Entrants who answer incorrectly will not be entered into the prize draw and are not entitled to a refund or replacement entry, save where the question itself is found to be defective.
6. Ticket prices, limits and availability
- Ticket prices are shown in GBP (ยฃ) and are inclusive of any applicable taxes.
- Each competition has a fixed maximum number of tickets and a per-customer ticket limit displayed on the competition page. We reserve the right to enforce these limits and to cancel any entries exceeding them.
- Adding tickets to your basket does not reserve them. Tickets are only allocated once payment is successfully completed.
- Ticket numbers are allocated at random by the Site immediately after payment is confirmed.
7. Payment
Payment is taken at the time of purchase by our third-party payment provider. We do not store full card details. If a payment is later reversed, charged back or found to be fraudulent, we may void the associated entries and tickets without notice.
8. Right to cancel, no refunds, and site credit
All ticket sales are final. You expressly waive any right of cancellation or refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which do not apply to competition entries once the draw process has begun or the service has been performed.
- Once a ticket has been purchased and a ticket number issued, the entry cannot be refunded, exchanged, transferred or resold.
- We reserve the right at our absolute discretion to amend, suspend, postpone, re-draw or withdraw any competition at any time before the published draw date, including (but not limited to) where minimum ticket thresholds are not met, where a prize becomes unavailable, where there is suspected fraud or technical error, or where required by law or any regulator.
- Where we withdraw or cancel a competition before the draw, paid entrants will be refunded the value of their ticket(s) in site credit, which can be used towards future entries on the Site. Site credit has no cash value, is non-transferable, and may be subject to an expiry period notified at the time it is issued. Cash refunds will only be issued where we are legally required to do so.
- Where a competition has already been drawn, no refunds or site credit will be issued except in the case of a proven material error on our part.
9. The draw
- Each competition closes on the date and time stated on the competition page (the "Closing Date"), or earlier if all tickets are sold.
- The winner is selected at random from all valid entries (paid and free) using a verifiable random selection method, normally on or shortly after the Closing Date. The draw is live-streamed on our social channels.
- By entering you agree that, if you win, you will appear on camera during the live draw and any related publicity. This is mandatory and is required so that viewers can see the winner collect their prize and confirm the legitimacy of the competition. If you are unwilling to be filmed you must not enter.
- We may, at our discretion, extend the Closing Date and/or reduce the prize where the minimum required ticket sales have not been reached. Where this would materially change the competition, affected entrants will be offered site credit as an alternative.
- The winner's first name, town and ticket number may be published on the Site and our social media. By entering you consent to this minimal publicity, which is a condition of the s.339 exemption.
10. Prizes
- The prize is as described on the competition page. Images are for illustration only and the actual prize may vary in minor respects (colour, specification, accessories).
- Where a cash alternative is offered, the value will be stated on the competition page. Where no cash alternative is offered, the prize is non-exchangeable and non-transferable.
- We will use reasonable efforts to deliver or arrange delivery of the prize within 30 days of the winner being verified, to a UK mainland address. Delivery to certain locations (Highlands, islands, Northern Ireland, Ireland, Channel Islands) may incur additional time and the winner is responsible for any import duties or local taxes outside Great Britain.
- Risk in the prize passes to the winner on delivery. Manufacturer warranties (where applicable) are provided by the manufacturer, not by us.
- The winner is solely responsible for any tax, insurance, licensing, registration or running costs associated with the prize.
11. Claiming the prize
We will attempt to contact the winner using the contact details on their account within 7 days of the draw. The winner must respond and verify their identity (proof of age and address) within 14 days of first contact. If a winner cannot be contacted or fails to verify within these periods, we reserve the right to forfeit the prize and re-draw, with the original entry receiving no compensation.
All prizes must be collected in person at Yannis Desserts, 87 Peartree Road, Derby, DE23 6QB on the day of the draw (or on a date agreed with us within 14 days of the draw). Travel to the collection location is the winner's responsibility. We do not arrange courier delivery or third-party collection for car or high-value prizes. If the winner is unable or unwilling to travel to Derby to collect the prize, they may forfeit the prize or elect the cash alternative (where one is offered) subject to our standard verification process.
12. Conduct & disqualification
We may suspend or terminate your account, cancel entries and forfeit any prize without refund if we reasonably believe you have:
- Breached these Terms or the rules of a competition;
- Used bots, scripts, automation, multiple accounts, stolen or fraudulent payment details, or any other unfair means to enter;
- Engaged in abusive, threatening, defamatory or unlawful conduct towards us, our staff or other entrants;
- Attempted to manipulate, hack, disrupt or reverse-engineer the Site or any draw process.
13. Responsible play
We are committed to keeping entry into our competitions fun and affordable. Please only spend what you can comfortably afford to lose. See our Responsible Play page for limits, self-exclusion and support resources including GamCare (0808 8020 133) and BeGambleAware.
14. Intellectual property
All content on the Site (text, images, logos, video, code) is owned by or licensed to us and protected by UK and international intellectual property laws. You may not copy, reproduce, distribute or create derivative works without our prior written permission.
15. Data protection
We process your personal data in accordance with our Privacy Policy and applicable UK data protection law (UK GDPR and the Data Protection Act 2018). By entering you consent to your name, town and ticket number being announced as winner where applicable.
16. Liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law. Subject to that:
- We are not liable for any indirect, consequential or special losses, loss of profit, loss of opportunity or loss of enjoyment.
- Our total aggregate liability to you in connection with any competition is limited to the total amount you paid us for entries into that specific competition.
- We are not responsible for any failure to perform our obligations caused by events outside our reasonable control (force majeure), including network outages, payment provider failures, courier delays, pandemic, war, or regulatory action.
17. Changes to these Terms or competitions
We may update these Terms from time to time. The "Last updated" date above will reflect any change. Material changes will be notified to registered users by email or on-site notice. Your continued use of the Site after a change constitutes acceptance of the updated Terms. We may also amend the rules of any individual competition where reasonably necessary; material changes will be communicated to affected entrants who will be offered site credit if they no longer wish to participate.
18. Complaints
If you have a complaint, please email admin@yanniscompetitions.co.uk with the subject line "Complaint" and we will acknowledge within 3 working days and aim to respond fully within 14 working days.
19. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, save that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
20. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
