1. Introduction
This Refund Policy applies to all ticket purchases and entries made on www.yanniscompetitions.co.uk (the "Site") operated by IDVS LTD trading as Yannis Competitions ("we", "us", "our"). It forms part of our Terms & Conditions.
All competitions on the Site are skill-based prize competitions run under the lawful exemption in section 339 of the Gambling Act 2005. They are not a lottery or a licensable gambling product. Every competition offers a free postal entry route with the same chance of winning as paid entries.
2. General principle โ all ticket sales are final
All ticket purchases are final. Once a ticket has been purchased and a ticket number issued, the entry cannot be refunded, exchanged, transferred or resold.
By completing a purchase, you acknowledge that you are purchasing an opportunity to enter a skill-based prize competition with an instant, non-refundable allocation of a random ticket number. The service is deemed to have been fully performed at the point of ticket allocation.
3. Statutory right to cancel โ waiver
You expressly acknowledge and agree that the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("CCRs") do not apply to your ticket purchase, because:
- The service (entry into a prize competition with immediate ticket allocation) is fully performed before the end of the statutory 14-day cancellation period; and
- Competition entries are exempt from the CCRs where the service has begun with the consumer's express agreement and acknowledgment that the right to cancel is lost.
By ticking the box at checkout confirming you agree to these terms, you expressly request immediate performance of the service and waive any statutory right to cancel or receive a refund under the CCRs. This waiver is in addition to, and does not affect, your statutory rights as a consumer where the goods or services supplied are not as described, not of satisfactory quality, or not fit for purpose.
4. When refunds may be given
Despite section 2, we may issue a refund or site credit at our absolute discretion in the following limited circumstances:
- Competition cancelled before draw โ If we withdraw, suspend or cancel a competition before the published draw date (for example, due to insufficient entries, prize unavailability, suspected fraud, technical error, or legal/regulatory requirement), paid entrants will be refunded the value of their ticket(s) in site credit. Site credit can be used towards any future competition entry on the Site. See section 5 below for terms of site credit.
- Proven material error โ If we make a proven material error (for example, a duplicate charge, a charge for a competition that was not live, or a technical fault on our part that prevented proper entry), we will refund the overcharge or erroneous payment to the original payment method or as site credit at your election.
- Incorrect skill answer โ defective question โ If you answer the skill question incorrectly, your entry is void and you are not entitled to a refund. However, if a skill question is subsequently found to be ambiguous, defective or impossible to answer correctly, and this is confirmed by us, affected entrants will be offered a refund in site credit.
- Legal requirement โ Where we are legally required by a court, regulator or enforceable consumer-protection authority to issue a cash refund, we will comply.
5. Site credit terms
- Site credit is issued at our discretion, normally when a competition is cancelled before draw. It represents a prepaid balance that can be applied towards future ticket purchases on the Site.
- Site credit has no cash value and cannot be withdrawn, transferred or exchanged for cash.
- Site credit is non-transferable between accounts. It can only be used by the account holder to whom it was issued.
- Site credit may be subject to an expiry period, which will be notified at the time it is issued. If no expiry is stated, site credit expires 12 months from the date of issue.
- Site credit is applied automatically at checkout before any other payment method, up to the value of the basket. If the basket total exceeds the site credit balance, the remainder must be paid by card.
- Unused site credit will be forfeited on account closure (whether voluntary or due to breach of terms) unless we are legally required to refund it.
6. Chargebacks and payment disputes
If you initiate a chargeback, payment reversal or dispute with your card issuer or payment provider without first contacting us and giving us a reasonable opportunity to resolve the matter, we reserve the right to:
- suspend or close your account;
- void all associated entries and tickets;
- forfeit any prize won using disputed entries;
- recover our costs, including bank and administrative fees; and
- report the matter to relevant authorities where fraud is suspected.
We strongly encourage you to email admin@yanniscompetitions.co.uk with any payment concerns before raising a dispute with your bank.
7. Prize-related issues
- Prize not as described โ Where a prize is materially different from the description on the competition page (other than minor illustrative variations in colour or specification), the winner may elect to receive a cash alternative of equivalent value (where offered) or site credit. This does not apply to winners who have already accepted and taken delivery of the prize.
- Prize unavailability โ If a prize becomes permanently unavailable before the draw, we reserve the right to substitute a prize of equivalent or greater value, or offer the winner a cash alternative. If no suitable alternative is available, the competition may be cancelled and paid entrants refunded in site credit.
- Delivery issues โ Risk in the prize passes to the winner on delivery. We are not liable for courier delays, loss or damage in transit once the prize has been handed to the courier, but we will use reasonable efforts to assist with courier claims.
8. Account closure and dormant accounts
If you close your account voluntarily, no refund will be issued for any unused tickets, active entries or site credit balance, unless we are legally required to do so.
Accounts that have been inactive for 24 months may be closed and any remaining site credit forfeited, after we have used reasonable efforts to notify you at your registered email address.
9. How to request a refund or raise a dispute
If you believe you are entitled to a refund or site credit under this policy, please email us at admin@yanniscompetitions.co.uk with:
- your full name and registered email address;
- the competition title and date of purchase;
- the reason for your request; and
- any supporting evidence (screenshots, payment references, etc.).
We will acknowledge your request within 3 working days and aim to provide a full response within 14 working days. Complex cases may take longer; we will keep you informed of progress.
10. Changes to this policy
We may update this Refund Policy from time to time. The "Last updated" date at the top of this page will reflect any change. Material changes will be notified to registered users by email or by an on-site notice. Your continued use of the Site and purchase of tickets after a change constitutes acceptance of the updated policy.
